Study hour

On May 2 of this year, another hour of legal training was conducted through the ZOOM platform for employees of the central office of the State Unitary Enterprise “Center for Electromagnetic Compatibility”, Electromagnetic Compatibility Services of the Republic of Karakalpakstan and regions.

At this training hour, the leading engineer of the Logistics and Construction Service S. Nurushov explained the content of the Law of the Republic of Uzbekistan “On Public Procurement” dated April 22, 2021 No. ZRU-684.

The legislation on public procurement consists of this Law and other acts of legislation.

If an international treaty of the Republic of Uzbekistan establishes rules other than those provided for by the legislation of the Republic of Uzbekistan on public procurement, then the rules of the international treaty apply.

The following basic concepts apply in this Law:

beneficial owner - an individual who ultimately owns property rights or actually controls the supplier of goods (works, services);

an auction to reduce the starting price is - a competitive way of carrying out public procurement on a special platform of the electronic public procurement system, in the organization of which the only criterion for determining the winner is price;

state customer - a legal entity carrying out public procurement;

state procurement -  the process of meeting the needs of government customers for goods (works, services) on a paid basis;

public procurement agreement - an agreement between the state customer and the public procurement contractor on the establishment, modification or termination of rights and obligations in public procurement;

subjects of public procurement - state customer, participant in procurement procedures, executor of public procurement, procurement commission, operator of an electronic public procurement system, specialized organization and expert, expert organization;

prequalification - a procedure carried out by the procurement commission for selecting qualified participants in procurement procedures who are allowed to conduct procurement procedures that comply with the technical, economic, organizational and other features established in the procurement documentation;

reserve winner - a participant in procurement procedures whose proposal, based on the results of procurement procedures in accordance with the decision of the procurement commission, was recognized as the most optimal, following the proposal of the winner;

 

tender - a competition that provides for the procedure for determining the contractor of public procurement through a competitive procedure for carrying out public procurement, according to the results of which the participant in the procurement procedures who offered the best conditions for the execution of the public procurement contract is recognized as the winner;

procurement procedure - a set of actions related to the implementation of public procurement;

affiliated person of a participant in procurement procedures - an individual or legal entity that has the right to make a decision and (or) influence, including on the basis of a written agreement, on the decision-making of this participant in procurement procedures, as well as an individual or legal entity that has such a right in relation to to this participant in procurement procedures;

Unified register of contracts - a register of public procurement contracts concluded by government customers, which is maintained by the authorized body in the field of public procurement on a special information portal;

electronic government procurement - a form of public procurement through the use of information and communication technologies;

electronic store - a competitive way of carrying out public procurement of goods (works, services) for which there are no specific requirements, which provides for the conduct of trading in electronic form on a special platform in the electronic public procurement system;

selection of the best offers - a competitive way of carrying out public procurement based on comparison of proposals received from several participants in procurement procedures;

announcement - an information message about upcoming public procurement indicating the method of implementation, requirements and conditions of public procurement, deadlines and procedure for submitting proposals, posted by the state customer in the electronic public procurement system through a special information portal;

winner - a participant in procurement procedures whose proposal is recognized as the most optimal based on the results of procurement procedures.

The basic principles of public procurement are:

professionalism and responsibility;

validity;

rationality, economy and efficiency of use of financial resources;

openness and transparency;

competition and objectivity;

proportionality;

unity and integrity of the public procurement system;

inadmissibility of corruption.

The basic principles of public procurement should be applied at all stages of the public procurement process.
