On May 30 of this year, another hour of legal training was conducted through the ZOOM platform for employees of the central office of the State Unitary Enterprise "Center for Electromagnetic Compatibility", the Services of Electromagnetic Compatibility of the Republic of Karakalpakstan and regions.

At this training hour, the engineer of the Service for Logistics and Construction, Kh. Asamov, explained the content of the process of public procurement of the Service for Logistics, Technical Support and Capital Construction at the State Unitary Enterprise “Center for Electromagnetic Compatibility”.

Purchases at the State Unitary Enterprise “Center for Electromagnetic Compatibility” are carried out according to the following regulatory documents:

1. Law “On Public Procurement” No. 684 of April 22, 2021;

2. Resolution of the President of the Republic of Uzbekistan “On the settlement of relations in the field of public procurement” dated September 27, 2018 No. 3953;

3. Resolution of the President of the Republic of Uzbekistan “On additional measures to support domestic producers” dated August 21, 2020 No. 4812.

Basic principles of public procurement.

The main purpose of this Public Procurement Law is to regulate relations in the field of public procurement;

Professionalism and responsibility;

Validity;

Rationality, economy and efficiency of use of financial resources;

Openness and transparency;

Competition and objectivity;

Unity and integrity of the public procurement system;

No corruption allowed.

The Public Procurement Law provides for the implementation of electronic tenders such as:

Electronic store:

Purchases in the electronic store are carried out according to the following criteria:

 Goods valued under one contract up to 25,000 (twenty-five thousand) basic estimated value (BRV);

 Works, services worth under one contract up to 100 (one hundred) amounts of the basic estimated value (BRV);

Auctions:

 Goods are put up for auction according to the following criteria:

 The cost of goods under one contract must be up to 25,000 (twenty-five thousand) of the basic calculated value (BV);

 Public procurement of services and works cannot be the subject of an auction.

 Selection of the best offer (competitive bidding):

 The selection of the best proposal is carried out according to the criterion of determining the winner, which has not only a monetary, but a quantitative and qualitative assessment of the public procurement of goods (work, services);

 The cost of goods (work, services) under one contract is up to 25,000 (twenty-five thousand) of the basic estimated value (BV).

 Tenders:

 Tenders are carried out according to the criterion of determining the winner; they have not only a monetary, but a quantitative and qualitative assessment of the public procurement of goods (work, services);

 The cost of goods (works, services) is over 25,000 (twenty-five thousand) basic calculated values ​​(BV) under one contract.

The procedure for public procurement under direct contracts:

 Public procurement under direct contracts can be carried out in the following cases:

 Public procurement of goods (works, services) permitted for public procurement from a single supplier included in the Register of Single Suppliers;

 Public procurement of goods (work, services), carried out under direct contracts on the basis of decrees and resolutions of the President of the Republic of Uzbekistan, resolutions of the Cabinet of Ministers of the Republic of Uzbekistan;

 State procurement of goods (works, services) necessary to meet the needs of the Republic of Uzbekistan in order to eliminate emergency situations;

 Public procurement related to the appointment of a lawyer (representative) to participate in legal proceedings;

 State procurement of the results of intellectual activity, such as works of science, literature and art, performances, phonograms, broadcasts of broadcasting or cable broadcasting organizations, from the only person who has the exclusive right to this object of intellectual property;

 State procurement of goods (works, services), prices (tariffs) for which are regulated by the state.

Also, the Decree of the President of the Republic of Uzbekistan dated September 27, 2018 No. 3953 On measures to implement the Law of the Republic of Uzbekistan “On Public Procurement” cites 47 cases, including:

1. Tickets (for air, railway and route transport) for business trips and in other cases related to the activities of the state customer.

2. Expenses for accommodation on business trips and other cases related to the activities of the state customer.

3. Purchases of communication services, Internet and television and radio broadcasting from suppliers under previously concluded contracts.

4. In the absence of the possibility of providing services by another supplier after the expiration of the warranty period for goods (work, services) previously imported by the supplier and routine maintenance (purchase of spare parts), as well as monitoring of a previously purchased software product and (or) its functional expansion.

5. Banking (interbank) services and operations.

6. Rental of buildings, structures and equipment for organizing and conducting sports, cultural events, exhibitions, fairs, conferences, seminars and training sessions.

7. 7. Providing visits of official delegations of foreign countries and international organizations (hotel, transport services, equipment rental, food supply, translation services), receiving souvenirs, gifts, flowers and floral decorations, holding receptions for representative offices (dinner, buffet, coffee break, etc.), preparation of concert programs, banners and booklets, as well as expenses associated with the visit of the state delegation of the Republic of Uzbekistan to foreign countries.

8. Holding a press conference, briefing, thematic TV show and other events in the media, advertising, printing articles.

9. Other necessary goods (work, services) to prevent the spread of natural phenomena, epidemics and diseases or eliminate their consequences, approved by authorized bodies in the event of emergency situations.

10. Operating expenses for the acquisition or rental of residential or non-residential premises (structure), as well as for its maintenance.

11. Subscription to periodicals (newspapers, magazines), including their electronic versions.

12. Services for compulsory insurance and within the framework of state health insurance.

13. Tickets for cultural events.

14. New cars, special equipment and agricultural machinery purchased from manufacturers of the Republic of Uzbekistan or their official dealers and distributors.

15. Gasoline, liquefied and compressed gas, diesel fuel and coal products.

16. Repair services for special and official vehicles, as well as medical equipment.

About additional measures to support local producers:

In order to support domestic manufacturers, according to the Decree of the President of the Republic of Uzbekistan dated August 21, 2020 No. 4812 “On additional measures to support domestic manufacturers,” through the portal cooperation.uz you can purchase products from domestic manufacturers, such as:
