On December 26 of this year, another hour of legal training was held through the ZOOM platform for employees of the central office of the State Unitary Enterprise "Center for Electromagnetic Compatibility", the Electromagnetic Compatibility Services of the Republic of Karakalpakstan and the regions.
During the class hour, the 2nd category engineer of the SEMC of the Kashkadarya region Sh. Djalilov explained the content of the Law of the Republic of Uzbekistan "On guarantees of equal rights and opportunities for women and men" dated September 2, 2019 No. UP-562.
The purpose of this Law is to regulate relations in the field of ensuring equal rights and opportunities for women and men.
The following basic concepts are used in this Law:
temporary special measures to ensure the implementation of gender policy - legal, organizational and institutional measures taken by government bodies to eliminate gender inequality and achieve specific goals to ensure actual or fundamental equality of women and men;
gender - the social aspect of relations between women and men, which manifests itself in all spheres of society, including politics, economics, law, ideology and culture, education and science;
gender statistics — part of state statistics, including data disaggregated by gender on the status of women and men in all spheres of society, reflecting the corresponding status of persons of different sexes in all spheres of socio-political life, highlighting gender issues and relations in society;
gender-legal expertise — analysis of regulatory legal acts and their drafts for compliance with the principles of ensuring guarantees of equal rights and opportunities for women and men;
gender audit — study and assessment of the state of compliance with the requirements of legislation on guarantees of equal rights and opportunities for women and men, as well as a comprehensive gender approach in the activities of government agencies and organizations, including in the implementation of personnel policies;
direct discrimination on the basis of gender — any distinction, exclusion or restriction that is aimed at non-recognition of women's and men's rights and freedoms in all spheres of society, including discrimination based on marital status, pregnancy, family responsibilities, as well as sexual harassment, different pay for equal work and qualifications;
indirect discrimination based on gender — the creation of a situation, position or criteria that puts persons of one gender in a less favourable position compared to persons of the other gender, including the promotion of gender inequality through the media, education, culture, the establishment of conditions or requirements that may entail negative consequences for persons of a certain gender;
a comprehensive gender approach — the organisation of activities by state bodies and organisations, including the implementation of personnel policies in accordance with the legislation on guarantees of equal rights and opportunities for women and men.
The main principles of ensuring guarantees of equal rights and opportunities for women and men are:
legality;
democracy;
equality of women and men;
inadmissibility of discrimination on the basis of gender;
openness and transparency.
Non-admission of discrimination on the basis of gender
Women and men have equal rights and opportunities guaranteed by the state.
The following shall not be considered discrimination on the basis of gender:
establishment of differences in the regulation of relations related to the functions of childbirth and breastfeeding;
conscription for compulsory military service in the manner prescribed by law;
adoption of temporary special measures on the basis of this Law to ensure the implementation of gender policy;
special features of labor protection of women and men related to the protection of their reproductive health;
provision of recommendations for professional qualifications based on the possibility of performing duties only by persons of a certain gender;
establishment of differences in the regulation of the procedure and conditions of detention in places of detention, execution of punishment and other measures of legal influence;
positive measures aimed at strengthening the social status of women in society, ensuring equal rights and opportunities for women and men.
Public administration in the area of ensuring equal rights and opportunities for women and men is carried out by the Cabinet of Ministers of the Republic of Uzbekistan, the Republican Commission on Enhancing the Role of Women in Society, Gender Equality and Family, as well as state bodies within the limits of their authority.
